Assaults Upon School Employees

It is the policy of Northeast Tech to ensure that any school employee who is a victim of assault, battery, or aggravated assault and battery while performing their duties has a clear reporting procedure and receives appropriate support.

Definitions:

  • Assault - An assault is any willful and unlawful attempt or offer with force or violence to do a corporal hurt to another.

  • Battery - A battery is any willful and unlawful use of force or violence upon the person of another.

  • Aggravated assault and battery:(a) An assault and battery become aggravated when committed under any of the following circumstances: When great bodily injury is inflicted upon the person assaulted or when committed by a person of robust health or strength upon one who is aged, decrepit, or incapacitated. (b) For purposes of this section “great bodily injury” means bone fracture, protracted and obvious disfigurement, protracted loss or impairment of the function of a body part, organ or mental faculty, or substantial risk of death.

  • School Employee includes all appointed persons, contractors, and school board members acting in their official capacity.

Reporting Procedures:

Immediate Notification:

  • Any school employee who is a victim of assault, battery, or aggravated assault and battery while performing their duties must notify the superintendent, building administrator, or an officer of the Northeast Tech Police Department.

  • The administrator and/or designated employee receiving the report must notify the superintendent.

State Reporting Requirements:

  • The superintendent and/or designated employee shall submit a report to the State Department of Education by July 1 of each year, detailing all incidents from the previous year. The report shall include a description of each incident and its final disposition.

Legal Protection for Employees:

  • No school employee shall be subject to civil liability for reporting or assisting in reporting such incidents, provided that the report is made in good faith and without malicious intent.

Employee Policy Distribution:

  • Northeast Tech shall maintain a written policy outlining the reporting procedures for assaults on school employees.

  • A copy of this policy shall be delivered to every school employee upon employment and updated as necessary.
